California Gov. Gavin Newsom’s executive order creating a COVID-19 presumption was unconstitutional because he doesn’t have the authority to create workers’ compensation laws or change the Labor Code, a Southern California-based work comp defense firm says.
Attorneys from Floyd Skeren Manukian Langevin said they’ve filed several petitions with the Workers’ Compensation Appeals Board — most recently Aug. 5 — alleging that Newsom’s May 6 order is invalid because the governor acted outside his powers when he created the presumption.
