Property Owner Gets Dismissal of Labor Law Claim

A New York appellate court upheld the dismissal of a worker’s Labor Law claims against a property owner for a fall while performing routine maintenance. Case: Deangelis v. Franklin Plaza Apartments, No. 2018-09587, 12/02/2020, published. Facts: Franklin Plaza Apartments Inc. contracted with a company to maintain its boilers. Stephen Deangelis was dispatched to prepare and test the Franklin Plaza boilers for an upcoming city inspection. Deangelis used an extension ladder to access the top of a boiler.
