A family member of a worker who died of causes unrelated to his injury can continue receiving his wage-loss benefits, a New York appeals court ruled. The decision is another that overturns decades of practice and another slap against the state Workers' Compensation Board. The Supreme Court's 3rd Department, which handles workers' compensation appeals, last week found that the teenage son of a deceased worker should be granted the remaining 39 weeks of permanent partial disability benefits in a nonschedule loss of use injury.
