A divided Ohio appellate court panel ruled that an injured worker was required to repay the Bureau of Workers’ Compensation for temporary total disability benefits she received after the date her doctor declared her to be at maximum medical improvement.
Loretta Dillon injured her back while working for Jefferson Industries Corp. in April 2019. Dillon received medical treatment at the emergency room. About a week later, Dillon attempted to return to work, but pain forced her to stop within about two hours.
The next day, Dillon saw a chiropractor who certified her as disabled.
