Teamsters Ask Feds for More Time to Comment on Classification Rule

The International Brotherhood of Teamsters asked the U.S. Department of Labor to allow more time to comment on a proposal to adopt an “economic reality” test as part of the analysis used to decide whether a worker is an employee or a contractor.

The Department of Labor on Sept. 22 proposed adopting the test of whether a worker is in business for himself or herself and is a contractor or is economically dependent on an employer and is an employee. The department said it would accept comments for 30 days.

The Teamsters are asking that the comment period be extended to 60 days.

“This is no time for the Labor Department to try and ram through changes that would hurt workers just trying to support their families,” Teamsters General President Jim Hoffa said in a statement.

The Teamsters oppose the proposed rule.
