Worker Doesn't Need to Provide Notice of Occupational Disease Claim to Carrier

The Supreme Judicial Court of Maine ruled that a worker is not required to give notice of his occupational disease claim to his former employer's insurer when the employer no longer exists. Roger Desgrosseilliers performed sheet metal work in the 1960s, repairing asbestos-insulated ductwork, siding, roofing, lagging, boilers and hoods in paper mills throughout New England. In 2015, nearly 20 years after retiring, Desgrosseilliers underwent surgery for lung cancer and was diagnosed with asbestosis.
