Supreme Court Rules Injured Workers Have Choice of Pharmacy

Unlike its counterpart in Louisiana, the Kentucky Supreme Court has ruled that injured workers may choose their own pharmacy.  The high court's decision, which came down last Thursday, is a victory for defendant Injured Workers Pharmacy, a mail-order business based in Massachusetts. IWP sells medications on a lien basis, taking its orders from treating physicians instead of adjusters, and billing insurance companies for payment. Kentucky workers' comp claimants have been authorized to choose where they fill their prescriptions for about 23 years. IWP has been an option...
