Workers’ compensation is the exclusive remedy for a husband and wife whose throats were cut upon arriving at the scene of a double homicide because they were engaged in law enforcement activities at the time, a divided California Supreme Court ruled Thursday.
Because a Trinity County sheriff’s deputy asked James Gund and his wife, Norma Gund, to follow up on a 911 call, the high court said they were engaged in active law enforcement and not allowed to sue the county or the deputy, the five-member majority held in Thursday's decision.
