A divided Ohio Supreme Court ruled that the Bureau of Workers’ Compensation was entitled to recoup an overpayment of benefits to a worker between the time she reached maximum medical improvement and when her temporary total disability was terminated.
Loretta Dillon injured her back while working for Jefferson Industries Corp. in April 2019. The Bureau of Workers’ Compensation accepted liability for a lumbar strain/sprain, and a district hearing officer awarded temporary total disability benefits.
