The Illinois Chamber of Commerce is contemplating a constitutional challenge to an emergency rule handed down by the state Workers' Compensation Commission listing more than 35 occupations — all those deemed essential services in the governor's executive order — for which COVID-19 is presumed to be a compensable condition.
“We don't think the commission has that rulemaking authority,” said Jay Shattuck, executive director of the Chamber's employment law council. “We're working on a response that includes legal challenges.”
