The 9th Circuit Court of Appeals upheld the dismissal of complaints accusing the California insurance commissioner of bad faith and constitutional abuses in securing a conservation order for California Insurance Co.
The majority opinion says the prior exclusive jurisdiction rule, which precludes a second court from intervening after a court of competent jurisdiction has obtained control of particular property, supported the dismissal.
