The United States Court of Appeal, Second Circuit has ruled that a subrogation case of first impression must be sent the Vermont Supreme Court for determination of legal issues as to controlling law.In The Travelers Ins. Co. v. Carpenter (12/13/02 - No. 01-9474), Susan J. Carpenter was injured in an automobile crash in February 1999 and received workers' compensation benefits from The Travelers.
