FL - Fire Marshal Supports Proposed PTSD Presumption Legislation
State Chief Financial Officer Jimmy Patronis, who is also Florida’s fire marshal, is backing cancer and PTSD presumption legislation for first responders, WFLA-News Channel 8 reported.
Patronis told the station he supports measures that would award lost wages to first responders who develop mental injuries without accompanying physical ailments, commonly called “mental-mental” claims.
Current state law covers only medical benefits for post-traumatic stress disorder without physical injury.

OR - WCD Implements Legislative Changes to Death Benefit Calculation
Oregon’s Workers’ Compensation Division has announced that monthly benefits for all children of workers killed in industrial accidents will increase to 25% of the average weekly wage at the start of the year.
Monthly benefit amounts are unchanged for surviving children receiving payments at a rate of 25% of the AWW, or for surviving children and dependents with no surviving parent who are completing secondary education or obtaining a general education development certificate.
Any benefits currently being paid at the rate of 10%, however, must be increased to 25% at the start of t.
NM - WCA Schedules Training Sessions for Mandatory E-Filing System
The New Mexico Workers’ Compensation Administration will hold free training sessions throughout December on a new electronic filing system that will become mandatory at the start of the new year.
Effective Jan. 1, all represented parties will be required to use the Electronic Adjudication Management System, or EAMS, to file court documents in all workers’ compensation cases. Workers and employers who are unrepresented will not have to use the electronic filing system, but are encouraged to do so, the WCA said.
