House Passes Bill to Limit Awards for Deliberate Intent Injuries

The West Virginia State House of Representatives on Tuesday narrowly passed a bill that would cap awards for cases where an employer deliberately intended to injure a worker. Workers’ compensation is the exclusive remedy for West Virginia employees who are hurt at work unless they can prove an injury resulted from the deliberate intention of the employer to produce it. Under House Bill 3270, in cases where a worker proves an employer’s deliberate intent to cause injury or death, non-economic damages would be capped at $500,000.
