West Virginia Gov. Jim Justice signed a bill that identifies criteria that must be considered when deciding whether a worker is an employee or a contractor.
Justice on Friday signed Senate Bill 272, by Senate President Craig Blair, R-Berkeley, which requires that a person classified as a contractor be working under a signed contract that acknowledges the worker is not an employee and not covered by work comp or unemployment.
The worker must also be required to file an income tax return and exercise control over the manner and means by which the work is accomplished.
