Four decisions handed down recently by a New York appeals court have chastised the state Workers' Compensation Board for creating a policy with “no basis in law” that denies simultaneous classifications for schedule and nonschedule injuries.
The rulings upend years of practice by the board and could mean that hundreds of claims may have to be revisited by a comp board that has made efficiency in decisions a priority, attorneys said.
“It's going to be pandemonium,” said one insurance defense attorney.
