The Pennsylvania Supreme Court will weigh in on whether a provider seeking payment for an injured worker’s prescriptions may initiate litigation outside the forums established by the Workers’ Compensation Act and corresponding Medical Cost Containment Regulations.
The issue arose in a case called Elite Care RX v. Premier Comp Solutions LLC.
In May, a majority of the en banc Pennsylvania Superior Court ruled that Elite Care could pursue an action in a state trial court to resolve its dispute with a group of workers’ compensation insurance carriers for payment.
