In another rebuke to a famously outspoken workers' compensation judge, the South Carolina Supreme Court this week overturned her finding that a deafened claimant should be denied benefits because he appeared to be less than credible.
The decision in Danny Crane v. Raber's Discount Tire Rack could carry widespread significance and has some claimants' attorneys celebrating. Until now, appeals courts in South Carolina and elsewhere have largely left comp judges' credibility findings untouched, which gave some claimants scant recourse for appeal.
