Alleged billing errors do not give the Division of Workers’ Compensation authority to deny applications for recertification as a qualified medical evaluator, according to the latest complaint filed against the agency over its efforts to enforce the Medical-Legal Fee Schedule.
Two other complaints filed with the Los Angeles County Superior Court, and a related petition filed with the Workers’ Compensation Appeals Board, accuse the DWC of engaging in underground rule-making to create the grounds to allege improper billing.
